What does Data Processing mean?

"Personal Data" is any information that may be directly or indirectly attributed to you. For example, name, social security number, address, picture, e-mail and IP address. Even such information which cannot in itself identify you may be personal data if it can be linked to you in combination with other information.

"Controller" is the organization that decides on the purposes and means of processing Personal Data, i.e. how and why Data Processing is done.

"Data Processing" means all actions taken with your personal data. For example, collection, registration, storage, alteration, processing, structuring, destruction, etc.

Who is responsible for the Data Processing?

Lurkit AB, org. no. 559033-9973, Fridtunagatan 33, 582 13 Linköping, is the Controller for the processing of Personal Data carried out by us or on our behalf. This means that we decide on how and why your Personal Data is processed.

What we collect and why?

Lurkit mainly collects such Personal Data that is necessary to deliver our platform and services. This means that all or part of our service will not be usable by you if you do not want us to process your Personal Data.

Creating an account. When you create an account at Lurkit, we may process your username, IP address and your contact details such as your e-mail address. We may also collect your username and other data at a third party platform such as Twitch or YouTube if you create a connection between your account at Lurkit and applicable third party platform account, by which you are agreeing to be bound by the YouTube Terms of Service and Twitch Terms of Service respectively. If you create a company account at Lurkit, we may process your name, title, e-mail, IP address and contact details about your organization. We do this so that we can deliver the account to you and/or your organization and so that you can use our services at Lurkit. When you have created an account for creators at Lurkit we also provide you with an opportunity to upload a short biography and photos at your account that may be processed by us.

Online Streams. When you appear in certain games, images, news, contents or other streams that Lurkit collects from third parties such as Twitch, YouTube or in other games media, we will process your Personal Data contained in such stream for the only purpose of displaying such data at Lurkit and for Lurkit’s visitors.

Support. When you contact our support with questions or for other support, we may process your name, title, e-mail, IP address, contact details about your organization name, telephone number, previous messages and notes on the matter, information about the specific matter and other information that you provide us with and that may be relevant to your matter. This data is processed so that we can offer you the best possible service.

Newsletter and offers. We may process your name, title, e-mail, contact details about your organization name, telephone number in order to send you information about news and offers that may be of interest to you

Creator Program. We may also process and share your e-mail address and contact details to collaborations partners that you are being involved with as a Content Creator in our Creator Program in order for them to send you merchandise and/or other rewards applicable from time to time in the Creator Program. This Personal Data is also available for being exported by other collaboration partners in order for them to reach out to you and create new missions and rewards within the Creator Program. To avoid any misunderstandings, the processing that each collaboration partner performs to create and/or execute any missions or rewards within and/or outside the Creator Program is carried out as if the collaboration partners are independent controllers.

Visitor at lurkit.com. When you visit the website att lurkit.com, we process information about click and visit history, technical data from the devices you used (i.e. IP address, operating system, language, browser setting) and information about where you are when you visit our website, how long you have visited different parts of the website and if you have encountered any technical problems. We do this to create the basis for improving our website.

Purchases. When you make a purchase at Lurkit, we may process your name, your social security number or company organization number, address, telephone number, contact details about your organization name, e-mail, payment history, credit information and information about the specific purchase. We do this so that we can deliver our services to you and so that you can choose between different payment methods.

Collaboration partners. We process your name, title, e-mail and contact details about your organization. Such organization may be an employer to you and a customer, supplier or other organization that we collaborate with. We process this data to enable collaboration with you or your organization and to keep in touch with you or your organization.

Lurkit`s legal obligations. We process data about your name, social security number, contact information, payment history/information, information about your or your organization’s purchases and service matters in order to fulfil our legal obligations according to, among other things, the Accounting Act, the Money Laundering Act and the Swedish Income Tax Act.

Anonymous and aggregated data. We may furthermore process your data in an anonymous and aggregate manner for statistical purposes when we provide certain services. We do this so that we can improve our services and website.

Most of the Personal Data that Lurkit process is collected directly from you. However, we also collect certain data from third parties such as Twitch, YouTube or other gaming media when you appear in streams that Lurkit streams from such third parties.

What are the legal grounds for the Data Processing?

We always process your Personal Data in accordance with current legislation, including GDPR.

When we process your Personal Data in order to be able to provide you with our platform, services and support, inform about news and offers, keep in touch with you or your organization, improve and develop our services, or when you appear in certain streams that Lurkit streams from third parties we do so with the support of a so-called legitimate interest. We have then taken into account and weighed your interest of privacy in relation to our interest and purpose in the processing of Personal Data. In all above cases, taking into account both positive and negative effects, we have concluded that our interest is justified.

If we are to process your Personal Data for any purpose other than those mentioned above, we will inform you of this.

How long is your Personal Data stored?

The Personal Data we collect about you will be stored for as long as necessary, i.e. until your account is no longer active and for a period of 3 months thereafter. As regards to the Personal Data that is processed when you appear in streams that Lurkit streams collects from third parties, this Personal Data is not stored at all. It is only streamed.

Please note that certain Personal Data must be stored for a longer period if it is required by law. No Personal Data about you will be stored for longer than is necessary or in a manner incompatible with current legislation.

Is any of your Personal Data shared?

In order for us to offer you our services, it will in some cases be necessary for us to share your Personal Data with other companies. Companies that process your Personal Data on our behalf and according to our instructions are called processors. The processor will always enter into a data processing agreement with us to ensure that a high level of protection is maintained for your Personal Data.

We use processors to be able to handle your payment (payment service providers and banks), to market our services (media agencies, advertising agencies etc.) and for our IT services (operation and technical support of the website and other IT systems).

It also happens that we share your Personal Data with companies that are independent controllers once they have taken part of your Personal Data. This means that we no longer decide how your data is processed. This is the case, for example, when you click on a link, video, photo or stream that takes you to another website. This is also the case when we share your Personal Data with companies that offer payment solutions or companies that process your Personal Data in order for them to send you merchandise and/or other rewards or to reach out to you and create new missions within the Creator Program as described above.

We may also share Personal Data with a third party (such as the police, the tax authority or any other authority) in the case of a criminal investigation or if we are otherwise obliged to provide such information under law or a governmental decision.

Where in the world is the Personal Data processed?

Lurkit strives to only process your Personal Data within the EU/EEA. Even though our IT systems and servers are located within the EU/EEA, your information may need to be shared with a supplier or a subcontractor outside the EU/EEA, for example for support of our IT systems. If so, we will take the necessary steps to ensure that your Personal Data is processed at the same level of protection as in the EU/EEA. What are your rights?

You have the right to request access to the Personal Data processed about you at any time in accordance with GDPR and applicable data protection legislation. You also have the right to have inaccurate Personal Data about you corrected, in some cases to request the deletion of your Personal Data or restriction of our processing of your Personal Data, exercise your right to data portability and object to the processing of your Personal Data for instance Data Processing that is based on legitimate interest.
